More than a year after the fatal shooting of Oscar Grant by BART police, BART has fired police officer Marysol Domenici this week for her involvement in Grant’s death on New Year’s Eve 2009 on the Fruitvale BART platform. Domenici and her partner Anthony Pirone, were the first officers to respond to a call about an altercation on the BART train. In the video footage, Pirone appears to punch Grant before he’s dragged onto his knees. It’s widely expected that because Pirone’s conduct appeared to be more severe than Domenici’s, his firing will be announced soon. There were five other police officers on the scene, including Johannes Mehserle, who was caught on video shooting Grant in the back as he was held face down on the train platform. Domenici was famously quoted as saying that Grant would have lived if he had obeyed the police officers. "If they would have followed orders, this wouldn’t have happened," Domenici said at a preliminary hearing in Oakland, where Grant’s mother was in attendance, last year. Domenici later added, "If he had just sat down, he’d been fine." In the year since Oscar Grant’s death, BART hired the law firm of Meyers Nave to conduct an internal investigation, and several independent adminstrative hearings were held. Both Pirone and Domenici were put on leave, and have been collecting their respective $100,000 and $95,000 yearly salaries. Not much else has happened though. Mehserle was arrested and charged with murder, and had the decency to resign from the BART police force. His case was moved to Los Angeles, and has been languishing in pre-trial for months.
